The enactment of the Anambra State Homeland Security Law, 2025, by the State House of Assembly is a lackluster step towards enhancing security in the state. Its introduction, three years into Governor Soludo’s administration—a tenure marked by numerous killings and kidnappings never seen before in the state—raises pertinent questions about its timing and effectiveness.

While the law may have the objective to tackle crime and improve safety, a thorough review reveals fundamental flaws. These shortcomings render it outdated, overly punitive, economically harmful, and prone to abuse.

More fundamentally, it’s pertinent to approach equity with clean hands. The starting point of creating a secure environment is to entrench a law and order system across the board such that there would be consequences for every wrong action. In the case of Anambra State under Gov. Soludo, we have witnessed several breakdowns of law and order, from how PG elections are conducted in several communities to licensing of agberos in the name of revenue collection, to rising cult clashes, some of which stem from aggressive unorthodox revenue collection approaches. As if these were not enough, we were all witnesses to how he conducted LG elections and how he is fighting to control resources of Local Governments against what the Supreme Court has adjudicated. With these, you can now understand why insecurity has festered, given that the leadership that ought to pay attention to this pertinent problem is busy creating more problems and would rather focus on burial laws and how Igwes should confer chieftaincy titles.

Here are some of my observations on the new law:

  1. Conflict with the Nigerian Constitution

The Homeland Security Law confers quasi-policing powers on the Agunechemba security outfit, such as patrolling, making arrests, and conducting investigations. However, under the Nigerian Constitution, such duties are the exclusive preserve of the Nigeria Police Force. This creates a direct conflict with the constitutional framework.

Additionally, Clause 5(5) of the law permits security personnel to enter private residences without a warrant, violating constitutional rights to privacy (Section 37) and property (Section 44). This provision undermines the rule of law and exposes citizens to arbitrary intrusions.

  1. Unrealistic and Overbearing Provisions

Several clauses impose unrealistic and burdensome obligations on citizens:
• Monthly Security Reports from Community Leaders (Clause 13): Requiring community leaders to submit monthly reports is impractical and diverts them from their primary responsibilities.
• Obligations on Landlords and Hotel Operators (Clause 14): Mandating landlords and hotel owners to collect and verify detailed personal information from tenants and guests, and to install surveillance cameras, imposes undue financial and administrative burdens. These requirements are especially unrealistic for small businesses and rural communities.

  1. Economic Implications

The law’s stringent penalties, such as a ₦5 million fine for non-compliance by landlords, risk discouraging investment in critical sectors such as real estate and hospitality. Furthermore, the provision allowing property forfeiture for alleged links to criminal activities (Clause 15) creates an environment of uncertainty and fear, deterring property ownership and development. Forfeiture should only happen with proven basis and not alleged links.

The broader economic consequence is a chilling effect on entrepreneurship and tourism. Excessive regulation and punitive measures may portray Anambra as an unfriendly environment for investment, pushing potential investors and visitors to more accommodating states.

  1. Risk of Abuse and Political Exploitation

The expansive powers granted to the Agunechemba outfit and the Governor’s supervisory committee raise serious concerns about potential misuse. For example, Clauses 5 and 15 allow for detention, property searches, and asset confiscation, all without sufficient safeguards. Such powers could easily be abused for extortion or political intimidation.

Ambiguous terms like “questionable character” (Clause 5(4)) create room for arbitrary profiling and wrongful arrests. Moreover, the ability to close businesses or places of worship without judicial oversight (Clauses 15 and 19) threatens fairness and impartiality, raising fears of political persecution, especially in an election year.

  1. Disregard for Cultural Sensitivities

Clause 18 criminalises certain traditional practices involving charms, which are not inherently criminal. This blanket ban alienates local communities and undermines the cultural values of the people. Such measures risk fostering resentment and could reduce public cooperation with the law’s broader objectives.

  1. Weak Oversight and Accountability Mechanisms

The law lacks adequate provisions to ensure transparency and accountability in its implementation. While the Attorney General is empowered to review certain cases (Clause 17), this measure is insufficient to prevent potential abuse by Agunechemba operatives. The absence of robust oversight mechanisms leaves citizens vulnerable to injustice.

  1. Political Overreach and Timing

The timing of the law’s introduction raises concerns about its potential use as a political tool. By granting overwhelming control of Agunechemba to the Governor, the law could be exploited to intimidate opposition figures and dissenting voices. Anambra State, known for its vibrant political culture, must remain vigilant against any attempt to erode democratic principles under the guise of security enforcement.

Recommendations for Improvement

To address these challenges and make the law effective, the following changes are imperative:
• Align with Constitutional Provisions: Agunechemba should focus on intelligence gathering and community engagement rather than law enforcement, to avoid conflict with federal policing powers.
• Simplify Compliance Requirements: The obligations imposed on landlords, hotels, and community leaders should be made more practical and less costly.
• Promote Economic Growth: Penalties and compliance measures should be revised to support, rather than stifle, business activity and investment.
• Prevent Abuse: Independent oversight bodies should monitor Agunechemba’s operations, and vague terms like “questionable character” should be replaced with clear and objective criteria.
• Respect Cultural Practices: Engage with local communities to ensure that cultural traditions are respected while addressing legitimate security concerns.
• Ensure Non-Partisan Implementation: Clear safeguards must be established to prevent the politicisation of the Agunechemba security outfit.

In the end

The Anambra State Homeland Security Law, 2025, may appear to some as ambitious in its intent, just like Dubai Taiwan, but deeply flawed in its potential execution. As it stands, the law risks undermining constitutional rights, damaging the economy, and eroding public trust. A more balanced, inclusive, and transparent approach is necessary to achieve sustainable security in the state. Addressing these shortcomings will not only strengthen public confidence but also ensure that the law contributes positively to Anambra’s development and stability. These we must achieve whether with Soludo or not.

As of 2019/2020, over 3.6% of the global population resides outside their countries of origin, making issues of identity, borders, and governance more complex. Many in the Diaspora face unique challenges in their host countries, from identity and cultural adaptation struggles to difficulties navigating border and residency issues.

In response, countries of origin have begun to adopt policies to support and engage their citizens living abroad. In Nigeria, while some government initiatives exist to address these concerns of the Diaspora population, they remain insufficient.

Since diasporas are not homogenous groups, it’s crucial to clarify the target recipients of these policies. Diasporas consist of diverse individuals who differ significantly in socio-economic and demographic backgrounds and in the personal motivations that initially led them to emigrate.

This diversity results in a wide range of attitudes toward their countries of origin, from intense patriotism and support to profound disapproval of their home governments. Consequently, depending on their perspectives and backgrounds, countries of origin may choose to engage with diasporas as citizens or subjects in different ways, to largely disregard them, or even to actively exclude them.

It is time for us to stand united and address the insecurity that has devastated our homeland, making it a thing of the past—whether or not Governor Soludo prioritizes it. Under our collective watch, the most critical task at hand is ensuring that Ndi Anambra can once again sleep peacefully, free from fear.

We must move beyond assigning blame—whether to the churches, traditional institutions, or any other group. Coexistence is possible as long as we all operate within the bounds of the law. As our people wisely say, “Nwa mmụọ anaghị agba nwa mmadu; nwa mmadu anaghị agba nwa mmụọ” (Let neither the spiritual nor the human destroy one another). Enough is enough.

To the youth engaged in these harmful activities: I acknowledge the economic challenges you face, but destroying your own communities or life you haven’t created is not the solution. Reports confirm what we already know—both state and non-state actors have turned our region into a battlefield.

I call for immediate action:
1. A state security summit to develop sustainable solutions.
2. Greater accountability from security agencies.
3. Comprehensive youth empowerment programs to address root causes.
4. Organization, strengthening and synergizing of local security structures
5. ⁠Setup a “ See Something; Say Something” regime to garner deep intelligence to make criminals to be afraid of their shadows.

This is not about politics—it is about survival. The documented violations of Nigerian criminal law and international humanitarian law require urgent intervention.

No more delays. No more empty promises. The time for decisive action is now.

May God protect Ndi Anambra.

Paul, the leader of his school’s quiz team, had led them to numerous victories. However, during the final leg of the National Junior Schools Quiz Competition, Paul’s integrity was put to the test.

When asked to spell “AUDITORIUM,” Paul noticed that the answer was conveniently pasted on the microphone before him. Despite the temptation to win, Paul chose not to answer, citing that it would be cheating. Paul raised his hand and said, “Sorry sir, but the word is pasted on this microphone, and it would be Cheating if I answered it”.Paul was then given a tougher question and he couldn’t spell correctly.

Paul’s decision led to his school losing the competition. Many viewers and his schoolmates criticized him, labeling him “stupid” and “brainwashed” for prioritizing honesty over victory.

However, Paul’s parents welcomed him home with pride, commending his integrity and moral courage. Their reaction highlights the importance of values and principles over external validation or success.

Morality is a Private and Costly Luxury”.*

Next day in school when the Principal called out the Quiz team in the Assembly hall, it was Booos and curses for Paul by the students.*

Then the Principal spoke. “It’s a Sad thing that we Lost at the Quiz, but I’m Very Proud that Paul is a student of this school and would want all of you to Emulate him If you Ever find yourself in same situation.*

Winning the Competition would have brought us honor, but for how long will people remember that? What Paul did, however, will be a subject for discussion for a long time and it will always bring Glory to this school”.

A standing Ovation for Paul followed the Principal’s speech!

Two days later, one of the national dailies reporting the story on it’s Front page with Paul’s picture captioned it, “BEHOLD, THE HOPE OF OUR NATION!”

The chairman of one of the biggest banks in the country, an old student of the school, read the story and came calling a week later with a fat cheque and scholarship for Paul.

He also endowed an annual prize in his name for the Most Honest Student in the school.

When we do what is RIGHT, we Gain the Lord’s Approval, even IF the whole world condemns us… because there are times when the TRUTH will cost us more than a LIE, or even Cost us our Popularity or Success.

Moral of the Story.

One Evans, a notorious kidnapper, in one of the interviews granted to him said that they left Anambra State, because of the tight security in the state by HEPO.

His Excellency, Peter Obi made Anambra State a hot zone for kidnappers and the rest of the criminal gangs. Anambra State,then was the safest state in Nigeria if not the whole continent.

Sentiment aside.

Few days ago, on January 7th, was truly special as I joined esteemed personalities including His Grace, Archbishop Henry Ndukuba, the Primate of Church of Nigeria (Anglican Communion), many Bishops and clergies particularly of thr Anglican Church, His Excellency Mr. Peter Obi, my brother Senators Victor Umeh and Tony Nwoye, Professor Chinedu Nebo, Chief Osita Chidoka, Hon Obinna Chidoka and others at the formal opening of the permanent site of the University on the Niger, Umunya.

It was inspiring to witness this historic moment for pursuit of knowledge and formation of strong moral character in Anambra State under the visionary leadership of His Lordship, Rt Rev Dr Owen Nwokolo, the Bishop on the Niger. The permanent site stands as a testament to what we can achieve when we prioritize educational development and inspire people of goodwill to buy into such a grand vision.

I commend Senator Nwoye’s significant contribution through the facilitation of the dual carriage internal access road as a major Constituency project, which will greatly enhance the institution’s infrastructure. I remain committed to supporting initiatives that advance quality education in our region. May this institution grow to become a beacon of academic excellence, pursuit of knowledge with strong ethics and morals, and enhancement of leadership principles and entrepreneurship.

The Igbo have a saying that when a king misbehaves, his subjects will hide their faces behind a basket and speak to him in a language he understands. The security situation in Anambra State has deteriorated to such an extent that well-meaning citizens can no longer remain silent and watch things worsen further.

One clear fact in the South East today is that Anambra ranks highest in insecurity. The situation has become so dire that no week passes without horrible news about killings and abductions of citizens, while the state government carries on as though nothing is amiss.What has been shocking to me was the seeming conspiracy of silence among the elites, including religious leaders, Igwes, business entrepreneurs and various civil society groups.

Some months ago, a retired Anglican Archbishop in Anambra disappeared with his driver while in transit. From their abduction until their release three weeks later, the seat of government remained silent. Recently, criminals murdered a Catholic Diocese of Nnewi priest in his car in Ihiala, but the state government maintained its silence. Are we talking about the Nibo case or Ifite Awka case. A member of House of Assembly representing Onitsha North, Hon Justice Azuka, was kidnapped in Onitsha and till date, no meaningful information and no reaction from the government. The massacre in Ihiala was the only time the governor was prompted a bounty announcement without any strategy of prevention.

A young man called Big Ben has been missing for over a month and no reaction. I can go on and on. These incidents represent just a few of the many terrible happenings in the state that have elicited no response from the state government.

Even when many expected the government to provide security for those returning home to celebrate Christmas with their loved ones, they announced the deferment of such measures until after the Christmas and New Year celebrations—a decision that continues to shock. As expected, criminals operated freely, killing and kidnapping at will.

When Fr Ebube Muonso spoke out about the precarious security situation in the state and challenged the government to address these issues, all hell broke loose. Government agents began insulting the revered priest and calling him various names. While one could overlook many of these insults due to the character of those making them, the Information Commissioner’s shocking response left many speechless.

The commissioner’s use of gutter language against a priest of God, simply because the priest called on his state’s leader to protect his people, is most unbecoming of anyone holding public office. It becomes even more egregious coming from one who describes himself as a knight of the Church.

This behaviour is shameful, undignifying, and embarrassing, and deserves an unqualified apology.

When did it become anathema in Anambra State for citizens to question their government? When did it become a crime for citizens to protest against harmful government policies? Are we no longer in a democracy?

The right to question government policies stands as a cornerstone of democracy in Anambra State. Citizens’ voices, especially those raising concerns about public safety, deserve respect rather than retribution.

I wish to apologize to our revered priest for the insulting statements made against him by a government that has not only failed but refuses to accept advice. I urge Fr Ebube Muonso to take these insults in his stride and never allow himself to be intimidated by people who obviously do not mean well for their own state. Even this response from me will attract senseless reactions from these agents but I choose to ignore but remain steadfast in our demand for a better State. May you, Fr. Ebube Muonso, continue to join other well-meaning citizens in advocating for a better Anambra.

But I ask, where are the other religious leaders? Where are the media and other civil society groups? Where are the town unions? Where are the market leaders? Are you waiting to be the next kidnap or murder victim to lend your voice to the government to sit up to its primary role of protection of life?

Anambra’s future depends on our willingness to face these truths and demand better from our leaders. May God protect His people as we work toward the security and dignity our state deserves.
